False Accusations and Personality Disorders


He said/she said situations are difficult to judge. With no witnesses we are left to judging credibility or circumstantial evidence.

We see these situations in crimes such as rape/sexual assault or on the home front in the form of a Domestic Violence Petition/Restraining Order. In New Hampshire these are civil hearings and the Rules of Evidence are a bit "relaxed". Courts are all too often pressured into granting a petition when the evidence is not clear.

Err on the side of caution is the term I believe. Better safe than sorry. While these Protective Orders are necessary they must be judiciously applied as they are designed to limit a person's freedom to move about in public, a constitutional guarantee.

I am is support of this concept 150%......but I have seen more than one false accusation. They are pretty common actually. Why? Revenge is often a motive, or a "first strike" tool to pave the way for a divorce or accusation of sexual abuse, against a spouse or a child. It is a powerful weapon in a divorce and custody dispute.

One study of cases proven to be false noted a few interesting things:


The female (accusing) parent often is a hysterical or borderline personality or is angry, defensive and justifying.
The male (the accused) parent is generally passive, nurturing, and lacks "macho" characteristics.

I have seen a lot of false allegations in my work as a private investigator. In cases where they have been made by a female I have been introduced to Borderline Personality Disorder. Often seen along with Histrionics.

Individuals with BPD are often described as deliberately manipulative or difficult. False accusations are common. Impulsivity is usually seen in at least two areas that are potentially self-damaging or damaging to others: promiscuous sex, eating disorders, binge eating, substance abuse, reckless driving, reckless spending.

BPD is far more prevalent with females than males. People with BPD have a pervasive instability of moods which make it difficult to get along in relationships or with other people. Thus divorce. These individuals can be aggressive and manipulative. Thus false allegations, to get their way. Intimate relationships have really unstable patterns.

Investigators, Courts and Judges must do all they can to learn more about this affliction. As an investigator I have seen it and suspected it in many cases where serious allegations were made in a divorce or custody case.
